Crypto Tax-Loss Harvesting 2026: A Year-End Action Plan

A defensible 2026 loss-harvesting plan starts before December: reconcile basis, identify lots, classify tokenized securities, model capital netting and execute a real sale early enough to document it. A red number in a portfolio app is not yet a tax loss.

As of this review date, the September 15, 2026 estimated-tax installment is approaching. Reconcile year-to-date gains and income before deciding whether withholding or estimated payments need adjustment. Do not wait until the final hours of December to discover missing basis.

Build a complete portfolio inventory

Exclude internal wallet transfers from gains and losses, but track fees paid in crypto. A position without supported basis cannot produce a reliable projected loss.

Model the tax return, not only total P&L

Separate short-term gains and losses from long-term gains and losses, net within categories and then across categories. Apply any existing carryover. Only a remaining net capital loss can reduce other income, generally up to $3,000 or $1,500 for married filing separately.

A harvested short-term loss may be more valuable against short-term gains than against preferential long-term gains, but actual netting controls. State rules can differ. Run scenarios before selling and include transaction costs plus the replacement asset's lower basis.

Check wash-sale scope asset by asset

Section 1091 covers stock or securities. Non-security spot crypto generally falls outside the current statutory wording, while tokenized stock, debt or other security can fall inside. Options, futures, funds and wrapped rights require their own classification.

A valid loss needs a real year-end disposition

Execute an arm's-length sale or exchange that changes beneficial ownership. Retain order, fill, timestamp, proceeds, fee and blockchain or exchange confirmation. A self-transfer or journal entry is not enough.

The transaction must occur in the intended tax year. Time zones, exchange outages, pending blockchain transactions and thin liquidity create year-end risk. Complete planning with a margin for failed or delayed execution.

IRS Publication 550 explains that a digital-asset sale or trade held as a capital asset creates capital gain or loss and requires basis, value and transaction data.

Plan the replacement asset and future basis

If the loss is allowed and the taxpayer repurchases non-security spot crypto, the replacement lot normally receives its new purchase cost and holding period. This maintains exposure but increases the potential future gain compared with retaining the old basis.

If section 1091 applies, acquisition within the 61-day window can disallow the loss and adjust replacement basis. Coordinate accounts, spouses and retirement accounts where applicable. Do not rely only on a broker flag, particularly across multiple platforms.

Prepare for Form 1099-DA reconciliation

Broker gross-proceeds reporting can show the sale, but basis may be missing or incomplete. The IRS stated that most 2025 Forms 1099-DA would not include basis; future coverage expands under phased rules. The taxpayer remains responsible for the correct gain or loss.

Preserve lot identification and do not add broker proceeds to an already imported sale. Tokenized-security wash-sale adjustments can appear on Form 1099-DA, while ordinary spot-crypto tools should not fabricate them.

Update withholding and estimated tax

A realized loss can reduce projected capital gain, but staking, compensation and business income remain ordinary income. Recalculate total federal and state liability after execution rather than sending an estimated payment based on an obsolete dashboard.

Harvesting after the September installment can still affect the annual result. IRS Publication 505 explains the annualized-income method that may help when gains and losses are uneven, but it requires period records.

Final 2026 checklist

  1. Confirm tax residence and entity that owns each position.
  2. Reconcile basis and prior loss carryovers.
  3. Model short- and long-term netting.
  4. Classify each asset for section 1091.
  5. Select and document lots before sale.
  6. Execute a real disposition before year-end.
  7. Record any replacement purchase and new basis.
  8. Recalculate estimated tax and state effects.
  9. Reconcile Forms 1099-DA with the ledger.
  10. Retain Form 8949 workpapers and source exports.

2026 year-end harvesting FAQ

Must I sell by December 31?

A disposition intended for the 2026 calendar tax year must be completed in that year; do not leave execution to the final minutes.

Can staking income be harvested away?

Capital losses only reach ordinary income through the limited net-capital-loss deduction after netting.

Should I harvest every losing lot?

No. Compare tax value, fees, market risk, future basis and portfolio objectives.

Does Form 1099-DA calculate the loss for me?

Not necessarily; basis and cross-wallet history can be incomplete.

Can I buy back immediately?

Possibly for non-security spot crypto under current law, but asset classification and other limitations must be checked.

Does a swap realise a loss?

A taxable exchange can, measured using the fair market value of property received.

Do state rules match federal rules?

Not always. Model every filing state separately.

What happens to unused loss?

It generally carries forward after the annual capital-loss deduction limit.
