Crypto Estate Planning: Access, Inherited Basis and US Tax Rules

A crypto estate plan must solve two different problems: lawful authority and usable access. A will that names an heir cannot recover a lost seed phrase, while a seed phrase without legal instructions can expose the estate to theft, disputes and poor tax records. This 2026 guide joins the technical handoff with federal basis, valuation, gift and estate-tax requirements.

The legal layer identifies ownership, fiduciary authority, beneficiaries and distribution terms. The technical layer allows the authorized fiduciary to discover and control exchange accounts, wallets, signing devices and recovery material. Neither layer substitutes for the other.

Custodial platforms may use beneficiary designations or an estate process. Self-custodied assets may be unreachable without keys, but possession of a key alone does not settle legal ownership. State versions of fiduciary-access laws, platform terms and the estate documents affect what an executor may do.

Create an inventory without creating a theft map

Maintain a dated inventory showing the asset, network, approximate amount, custody type, account entity and where the access procedure is stored. Include hardware wallets, multisignature arrangements, staking positions, DeFi protocols, NFTs, domains and liabilities such as collateralized loans.

Do not place seed phrases, private keys, passwords or complete recovery codes in the inventory. A will may become a public probate record, and a broadly shared estate binder can be copied. The inventory should point an authorized person to a separately protected recovery process.

Preserve acquisition dates and basis alongside the ownership inventory. Heirs need both the date-of-death value and the history necessary to reconcile later sales. The crypto records checklist provides a supporting-data structure.

Design secure, testable access

Wills, trusts and beneficiary designations

A will should give the personal representative express authority to identify, access, secure, value and transfer digital assets, subject to state law. It should address who receives the economic property without embedding credentials.

A revocable living trust can support continuity and may avoid probate for assets validly owned by or assigned to the trust, but merely mentioning a wallet in a trust schedule does not guarantee that custody, control and title have been implemented. The trustee also needs a practical signing process. Trusts do not automatically eliminate income or estate tax.

Check beneficiary features at each custodial platform and ensure they do not conflict with the broader plan. For businesses, DAOs, multisignature treasuries and jointly controlled wallets, review operating agreements and key-person procedures as well.

What basis does inherited crypto receive?

Property acquired from a decedent generally receives basis equal to fair market value on the date of death. If the executor validly elects the alternate valuation date on Form 706, that value may apply instead. The IRS explains the general date-of-death rule in its gifts and inheritances FAQ and Publication 559.

That rule is often called a “step-up,” but basis can step down when market value is below the decedent's basis, and exceptions exist. For example, special rules can apply to appreciated property given to the decedent within one year and returned to the donor or donor's spouse. Income in respect of a decedent and certain trust distributions also require separate analysis.

The heir generally has a long-term holding period for property acquired from a decedent, regardless of how long the decedent or estate held it. A later sale is reported using the inherited basis, proceeds and any allowed transaction costs. See the US capital-gains guide.

Date-of-death crypto valuation

Record the valuation timestamp, time zone, market or pricing source, units, wallet addresses and any restrictions affecting value. A defensible process is especially important for thinly traded tokens, NFTs, locked staking positions, vesting rights, distressed exchange claims and assets spread across networks.

For a liquid token, retain consistent market evidence rather than selecting an advantageous intraday quote after the fact. An expert appraisal may be appropriate for illiquid or unusual property. If a required estate tax return establishes a final estate-tax value, the beneficiary may have a consistent-basis obligation and may receive Schedule A to Form 8971. Federal estate tax in 2026

Digital assets owned or controlled by the decedent can be included in the gross estate even when an exchange is abroad or the assets are self-custodied. For decedents dying in 2026, the IRS states that the federal basic exclusion amount is $15,000,000, increased from $13,990,000 for 2025. See the official 2026 inflation adjustments.

The old article's warning that the exclusion would fall by half in 2026 is obsolete after Public Law 119-21. The $15 million amount does not mean smaller estates can ignore planning: an executor may file Form 706 to elect portability, states can impose lower estate or inheritance-tax thresholds, and valuation or title disputes can arise at any estate size.

Form 706 is generally due nine months after death when required, with extension procedures available. Large holdings, non-US owners, prior taxable gifts, generation-skipping transfers and portability elections require professional advice.

Lifetime gifts are not the same as inheritance

A bona fide gift generally does not create income for the recipient upon receipt, but the recipient usually takes a carryover-basis framework rather than date-of-death basis. If value at the gift date is below the donor's basis, separate gain and loss basis rules can apply. Missing donor records can produce a zero substantiated basis.

The annual gift-tax exclusion is $19,000 per recipient for 2026. Exceeding it does not automatically create gift tax, but it often triggers Form 709 and uses part of the donor's lifetime exclusion. Executor's crypto workflow

  1. Obtain legal authority before moving assets and preserve the original devices and records.
  2. Identify custodial accounts, self-custody wallets, protocols, liabilities and pending rewards.
  3. Secure keys without mixing estate assets with a fiduciary's personal wallets.
  4. Capture balances and defensible fair market values at the applicable valuation time.
  5. Notify platforms through their estate process and prevent unauthorized access.
  6. Determine whether to hold, sell or distribute in kind under the governing documents.
  7. Record post-death income and dispositions separately from the decedent's final return.
  8. Provide beneficiaries with units, valuation, basis, acquisition character and any Form 8971 information.

An estate that sells crypto can have a reportable capital transaction. A direct transfer at death is not itself a sale. Maintain separate ledgers for the decedent, estate and each beneficiary.

Evidence the family should preserve

IRS Publication 551 explains inherited and gifted basis. Keep the legal file, valuation file and transaction ledger cross-referenced but protect credentials with stricter access.

Should a seed phrase be written into a will?

No. A will can become public and be copied. Store the secret separately and let the will authorize a secure recovery process.

Does inherited crypto always get a higher basis?

No. Basis is generally fair market value at death and can be lower than the decedent's basis. Exceptions and consistent-basis rules may apply.

Does an heir pay income tax just for receiving crypto?

A bequest is generally not income to the beneficiary, but estate tax, state inheritance tax and later gain or income can still matter.

What is the 2026 federal estate-tax exclusion?

The federal basic exclusion amount is $15 million for decedents dying in 2026. State thresholds and other filing reasons may differ.

Does a trust automatically avoid probate and tax?

No. The trust must be valid, funded and operational for the assets involved. Tax treatment and probate effect depend on the structure and state law.

What if heirs cannot find the wallet?

Legal ownership does not reconstruct a lost private key. The plan needs a discoverable inventory and tested technical recovery path before death or incapacity.

Is gifting crypto during life better than leaving it at death?

Not automatically. Lifetime gifts usually carry the donor's basis, while inherited assets generally use date-of-death value. Estate, gift, control and family goals must be compared.

Can an executor move crypto immediately after death?

The executor should first confirm legal authority, preserve evidence and secure the assets without mixing them with personal property. Platform and state-law procedures apply.
