US Crypto Tax Deductions: Losses, Fees and Business Costs

A crypto cost does not become deductible merely because it appears in a trading account. Capital losses, basis adjustments, investment interest, charitable contributions and ordinary business expenses follow different federal rules and must not be counted twice.

Start by identifying why the cost exists. A fee to acquire a capital asset can affect basis; a cost of a genuine trade or business may be a current expense or capital asset; a personal expense is generally nondeductible. The same dollar cannot be deducted and added to basis.

Capital losses: $3,000 limit after netting

Capital losses first offset capital gains under the short-term and long-term netting rules. If total losses exceed total gains, an individual may generally deduct the lesser of the remaining net loss or $3,000 against other income—$1,500 for married filing separately. The unused amount carries forward.

Current statutory wash-sale rules generally target stock or securities, so ordinary spot crypto that is not a stock or security may fall outside them. But token classification, related-party rules, economic substance and future law matter; do not advertise every immediate buyback as risk-free.

Trading and network fees usually belong in the transaction

Costs paid to acquire property generally increase cost basis when eligible. Costs of disposition can reduce amount realised. This lowers the gain or increases the loss but is not a second itemized deduction.

Network fees require flow-level analysis. If crypto is used to pay gas, disposal of the fee token can have its own gain or loss. A fee for moving assets between the taxpayer's wallets may not automatically enter the basis of a different token. Preserve purpose, asset and transaction hash.

Investor software and advisory costs are not business expenses

An investor cannot create Schedule C deductions merely by trading frequently, forming an LLC or buying a subscription. Personal tax-preparation, portfolio and advisory costs require analysis under the return-year itemized-deduction rules and may be limited or unavailable. They should not be added to a token's basis unless they are eligible direct acquisition or disposition costs.

Keep personal-investment expenses separate from fees of a genuine operating business. Using a business credit card does not change their character.

Ordinary and necessary crypto business expenses

Section 162 generally allows ordinary and necessary costs of carrying on a real trade or business. IRS Publication 334 explains that mixed personal costs must be separated and capital items cannot simply be expensed.

A home office must satisfy the statutory exclusive-use and business-use conditions. Meals, travel, vehicles and research have additional rules.

Mining and validator costs depend on business status

A profit-motivated mining or validator business may deduct eligible electricity, pool fees, repairs, rent and depreciation. Hobby or investor activity does not automatically receive the same deductions. Revenue must also be reported at its taxable USD value.

Allocate electricity and hardware between personal and business use with measurements, invoices and an operating log. Do not deduct equipment in full when capitalization and depreciation apply. The self-employed crypto guide covers Schedule C and self-employment tax.

Margin, loans and investment interest

Interest character follows how borrowed funds are used, not the collateral label. Business interest can be a business expense subject to applicable limits. Investment interest can be limited to net investment income and may require Form 4952. Personal interest is generally nondeductible.

DeFi “interest,” borrow fees, perpetual funding and liquidation charges are not interchangeable. Trace proceeds and contractual rights; separately analyse any token disposed of to pay the charge.

Lost keys, scams and exchange bankruptcy

A worthless token, frozen account or scam loss is not automatically a deductible capital loss. Determine whether the taxpayer still owns property, has a claim, made a disposition, abandoned an asset or suffered a theft under current statutory rules. Personal casualty and theft deductions are restricted.

Do not enter zero proceeds merely because market access stopped. Preserve police reports, insolvency claims, recovery distributions, wallet proof and correspondence. The crypto bankruptcy loss guide explains the decision tree.

Crypto donations are a separate deduction regime

A direct donation to a qualifying charity can avoid a sale by the donor and may produce a charitable-contribution deduction, subject to holding period, adjusted-gross-income limits, substantiation and appraisal rules. A transfer to an individual is a gift, not a charitable deduction.

Do not sell the crypto first and describe the cash gift as a direct crypto donation. Retain charity acknowledgment, wallet transfer, basis and qualified-appraisal documentation where required. See the US crypto donation guide.

Can I deduct all crypto losses from salary?

No. After capital netting, the annual ordinary-income deduction is generally limited to $3,000 or $1,500 if married filing separately.

Are exchange fees separately deductible?

They commonly adjust basis or proceeds rather than becoming a separate deduction.

Can an investor deduct every software subscription?

No. Investor costs are not automatically business expenses and current itemized rules can limit them.

Can a mining business deduct electricity?

Potentially, to the extent ordinary, necessary, documented and allocated to the business.

Is an LLC enough to claim business deductions?

No. The underlying activity must be a genuine trade or business and each cost must qualify.

Is a hacked wallet automatically deductible?

No. Ownership, theft, recovery rights and current loss provisions require analysis.

Can I deduct interest on a crypto-backed loan?

It depends on use of the borrowed proceeds and the applicable business, investment or personal-interest rules.

Can I deduct a gift of crypto to a friend?

No. Only qualifying charitable contributions use the charitable deduction regime.
